    Im not buying the car for cash, he wants to do straight swap on the with cars. He said he has $5000 left to payout. So thats the only thing that puts me off this car. Guy is in army and seems to be normal person.. thats only thing im scared.....

    Then he would need to pay out the loan on his car and take a new loan out on your car. That's the only way I see around it. Plus still get a REVS check as you never know who may have a financial interest in a second-hand car. Better safe than sorry.

    Thanks for that..... he said he is paying $100 weekly for loan.... is there a contract or something like that that we could sign that he will continue paying until is payed off?

    I wouldn't do it this way. What you want is to own the car outright. He needs to change the cars on his loan if he wants to do the swap. At the end of the day if he defaulted on the loan the debt collectors could come and repossess the car. It's not worth the hassle. If he's keen to do the swap then he's going to have to sort out his finances. I would do the swap at the finance company office with signing over paperwork etc so that you get a clean car and not somebody elses problem.

    So you saying he can transfer loan on to car that I will give him for his..... ??

    Yes he needs to find out from his finance company if they can do it. The other way is for him to get a brand new loan for his new car (i.e. yours) and use that to pay out the old loan.

    If you go through with the transaction he needs to have a $5000 loan for the car that he's keeping. End of story.
