Cops will give you a hard time about it over here, but by no means illegal.
The "heatshield box thing" is basically a 2 shields joined together that 'boxes' in the pod filter, effectively shutting out any hot air from the engine. You could just fabricate your own if you have the means and skill!
I've heard that open pod filters are illegal in NSW too. Is it legal everywhere else though??

I have a pod in my engine bay I have used a heat shield that I bought from Supercheap. Its a half shield so not completely covering it does the trick and puts out awesome sound.
On throttle 3000rpm+ you can hear the pod and it sounds like a V8 awesome.
I'm soo euro even my missus is shaved...

Would it be possible to some how mount a pod filter in original air box to use as heat sheild ? Or am I totally off the track ?
Apart from the sound of pots, in terms of effectiveness, straight pot with heat shield vs panel... similar?
hey mk3vr6 would you happen to have a pic of your set up?
Probably not enough space inside the filter box, theres also nowhere to mount the filter.
A BMC CDA is basically the same thing, with the added touch of ultra-sexy carbon fibre.
