Has anyone here taken a >5km/h over speeding fine to court, and used the ADR's as a Defence against these stupid tolerances?? I don't see how a state government rule can override a Federal government design mandate...

Yes, I saw one of these affair show. They used wrong drivers as an example. The drivers who lost the last demerit point and lost the license when they were driving way too much over the speed limit. They were arguing, if the greater tolerance was used they wouldn't lost their license.
Anyone with the 1/2 brain would have to ask them; what did you do that you lost so many demerit points and why did you speed almost 20km over the speed limit?

so let me get this right. I can now no longer use the speedometer in my car as a tool to indicate the speed i'm traveling at as it will be inaccurate due to all sorts of reasons outside of my control ,eg : the rolling radius of the tyre changing due to the heat difference from cold to hot when in use and the ambient temperature?
The lawmakers need to sort out the tw4ts who won't let each other merge/exit safely on freeways , tailgate and drive around in 20 year old 5h1tboxes that have never seen a spanner rather than concentrating on ridiculously minor speed infractions.

I think that the quote in the article was badly worded.
Previously the ADR allowed for + / - 10 per cent tolerance. Now it allows for +10 per cent only.
What this means is that, as is the case with all current VW's, the speedo tells you that you're doing 100km/h, but you're really only doing 93km/h (since they're about +7% out). Therefore, whether you've inflated your tyres too much, or just got brand new tyres, or even to account for the width of the needle, you're ok.
Drivers of older cars though - they're potentially stuffed
yeah , 107 on the speedo is bang on 100 using the sat nav and those freeway speedcheck things.
So whereas before you'd have gotten away with an actual 102 / 3 kph (speedo reading or 109 / 110 ) , now it's 100 (actual speed) exactly or you're booked?
I'm sure 1000's of life will be saved with this nonsense and it has nothing to do with revenue raising.
