maybe you should check which emissions requirements were in force in AUSTRALIA at the time.
ACCC is pursuing VW over misleading consumers (which in this case is all they are legally empowered to do), because under Australian law, emissions regulations were not breached...
(Edit: noting also that the Australian Government through its regulatory compliance functions, is NOT pursuing VW for the compliance of the relevant vehicles, because no ADR's were breached...)

No evidence champ. You've provided nothing. No links to definitive sources, only "your word" (excuse me if I don't believe you are an expert in this matter).
When you are able to provide actual evidence of what the case is about and what laws VW is alleged to have broken HERE IN AUSTRALIA then I'll happily engage in conversation with you - however it appears that you are a bandwagoner and don't actually understand the legal situation here in Australia at all - you just want to use the Europe and USA experience, and think the same applies.
I'm not suggesting that the cheat software they used was a good thing. IMO opinion (for whatever that is worth) they should not have done it. But what laws have they broken?
It is common for real world emissions to exceed lab emissions. That is why we have lab testing - to provide the same set of repeatable circumstances. If the vehicles met Euro 4 levels without the use of the defeat software (which is my understanding that they DID - defeat software may have been installed, but was materially irrelevant to meeting Euro4 standards), then there is no emissions case to answer (which is why they cannot be pursued on that front by the Aus Govt).
However they CAN be pursued because of the "clean diesel" claims made by VW - which however is more esoteric and it is up to the purchaser to prove that that claim was a major factor in their decision making process. The ACCC have taken this case in that regard because they don't have to meet the burden of "reasonable doubt" in cases of this type - they are not criminal cases.
But hey, it's your rant - if you are so upset by it all, why are you even here? Why don't you sell your VW and go after costs?

Manufacturers have always cheated when testing.
For example they used to use light oil and strip off all the ancillaries when testing to provide power figures. When cars became dependent on electronics it was just easier to cheat.
I do not think anyone who bought a VW did it because of the emissions figures, and everyone knows to take the fuel consumption figures as a fairy tale (and interestingly the two are linked). We bought VWs because of build quality and leading edge performance. We hoped they would be economical.
And although VAG were caught, almost everyone believes all the other manufacturers are doing the same thing.
This doesn't make it right, but it is what it is.
And if the ACCC are successful in prosecuting VW for misleading claims they should go after all the other manufacturers as well!
