The last transporter to be offered with a north/south engine was the T3 ('80s/90's) and that was in the back. All T4's & T5's are east/west. Maybe you're thinking of LT's/Crafters.
I never thought the T5.1 diesel was identical with the passenger cars, and VW seems to confirm that, but I'm not exactly sure of the difference. It's definitely east/west though, and not exactly roomy in there. Not sure that it has Urea injection either, but I have the 5 cyl (2007) so I'm clear.

I only have 6 months of warranty left so maybe Muarice Blackburn compensation will pay for the ECU remap to put it back again after the 6 months....??

I think he means less power / less economy. I think he'll be OK.
AFAIK, at max power, emissions controls are effectively bypassed anyway, so VAG should be able to maintain the max power on the "fixed" vehicles.
Mid-range power may suffer, but to win a claim, Ryeman would need to demonstrate that
- he bought his Volkswagen for the mid-range power, and
- he knew what it was before he bought it, and
- that he would not have bought his vehicle had those mid-range figures been lower.
Similarly, based on official economy specs, real world consumption is better. After the fix, for a claim to have merit, fuel consumption in the real world would need to worse than the figures published at the time he bought his car.
The class action is not about making anybody (other than the lawyers) wealthy. It's about compensation for loss(es) that are a result of VAG's deception - restoring owners to the position that they would've been in had the deception not occurred.
What are those losses? We've had the published power & torque, we've experienced better fuel economy than we otherwise might've had. Once the dust has settled, we probably own vehicles that have dropped in value, because the "fixed" vehicles will cost more to run and have less mid-range torque. I think all any of us will see is compensation for the drop in value - which will be calculated by somebody else.

I doubt anyone would have to produce a torque curve to prove deception.
The lawyers already have an admission of guilt.
The argument will be about the appropriate level of compensation

The forms they take....ie trade in accomodation / buyback / direct financial compensation
