Tom Tom selling traffic data to police

"Following reports that TomTom had sold traffic data collected from GPS device users to police who then used it to determine locations for speed traps, the company has issued a statement and video in an effort to appease angry customers."

Back fire: TomTom sold user data to police, motorists then targeted with speed traps

Not sure if it's happening in Australia, but something to consider when you fire up your GPS.

Update: TomTom To Sell GPS Data To Road Authorities, Private Companies

"TomTom Australia says it is planning to sell GPS data collected about its customers' journeys to road authorities and private companies even after it was forced to apologise when that same data was used by Dutch authorities to set speed traps."

Might be worth knowing when you consider your next GPS purchase.

I wonder if you can use the same data to fight a speeding ticket that was wrongly issued

No. The GPS data stored on the tomtom is not accurate enough to be used for that purpose.

If you want to keep data about your speed that you could use to fight a ticket you need video with an overlay from a 5Hz GPS including speed, HDOP, location etc.
