    Help! getting out of X-Pack

    Hi,

    I have recently placed an order for a Golf R which is due mid-late January. At the time of order (and signing of contract which was 22nd Nov 14) i had agreed to purchase the x-pack. After reading forums i have now decided against the x-pack.

    I emailed the dealer this morning and politely asked if i could remove the x-pack and resign the contract. They have emailed me back the following: "Thank you for your email however the order has already been put through for the protection for you so unfortunately I am unable to remove it.".

    I would like to know if i have any way of getting out of this? I Know i signed the contract however this was subject to lease finance approval, currently i have not finalised the lease finance (i.e. signed anything), so i'm thinking i may have an out in that regard. However i do not want to jeopardize getting the actual car, (just the x-pack).

    Can anyone please offer any assistance, let me know if you need any more information.

    If you signed the contract then you are pretty much stuffed unless the dealer wants to play ball and renegotiate.
    You could pull out and start a new contract but you would likely lose your deposit.

    You can try the lease finance not being approved so long as you don't affect your credit rating but like you said, the contract for the car falls through then.

    Call VWA and if the order has not started down the production line they are able to change your order at the request of the dealer, don't let the dealer stone wall you until its to late. I waited to long for my dealer to get back to us and missed out on Bi-Xenons by several days.

    Contact Volkswagen Australia asap and if they don't call you back today do it tomorrow morning or call until you talk to someone about it at head office.

    I did sign the contract, but i wasn't required to put any deposit down.

    The way i see it is that its all just some figures on paper at this stage, i.e. so what if an order has been placed to do an x-pack in two months time, surely that can be cancelled with no effect on the business??

    My gut feel is that they didn't oblige in there initial response to see if i would just accept the outcome. Perhaps with some follow up emails they might budge?

    My options as far as i can see are as follows:
    a) accept the response (No)
    b) re-request and plead with them to reconsider etc.
    c) Organise my lease finance to fall through and reapply (This could be playing with fire as they may not want to do business with me from then on)
    d) Threaten with some cooling off period or consumer protection clause or something that i am not aware of yet.

    I think i would prefer to go with option B at this stage. Does anyone have any advise onhow i could word such a response? Perhaps a phone call would be the best option?

    Currently the car is on a ship. They will not apply the x-pack until it gets into Perth in January (so the dealer told me).

    I might try calling head office as you suggested before i reply the dealer and see what they say. Cheers

    Simple fact is there is a tonne of margin in the x-pack. You may have gotten a larger discount on the car because of it.

    just call his bluff & tell him you'll walk if he doesn't remove the X-pack & the cost off the contract.

    Be prepared to walk though.

    Having just been through the purchase of a new car i would seriously read your contract of sale. It was pointed out to me that once the cooling off period was over if i wanted to cancel the order then i would be up for 2% of the purchase price.
    I believe this will be your situation too.

    Yep people on the forums cannot give you legal advice but as far as I was aware a car contract was very similar to that of purchasing property where if any external factor, i.e. finance, is not available it makes the contract null and void. This is also why it is important to have "financier of buyer's choice" on the contract.

    Call another dealership and say you want to buy a base-model or a GTI or anything and say you are a little worried about getting finance. Ask them if you are unable to find finance if you have to pay and penalties.
