And reimburse those of us that they have made to pay out of pocket expenses to repair defective vehicles, that they knew full well were defective to begin with!

That would fall under the consumer protections act for reimbursement, they cannot do that with only a handful of claims...you'd literally need sub 1000 of reimbursement claims (common sense) to see a penny back in your pocket.

That or a very strong class action...however be prepared for that to drag out for years...literally lol.

so in other words VW are waiting until they are forced to do a recall by the govt....

We have had about 6 VWs in the family.

4 have been working so far:
Golf V GTI 6DSG (except for the roof lining collapsing and generally easily scratched rubber knobs and switches)
Recently replaced with a 7 103TSI 7DSG Highline mk7 so might be too new to tell
Mk6 77TSI 7DSG MY11
Tiguan MY12 155TSI 7DSG

Two have had problems
Touran 103TSI 7DSG - gearbox failed. Engine shut off and stalled on highway
Jetta 103TSI 7DSG - engine stalled while cruising downhill. The cousin driving it couldn't use the brake. And with the Aircon and radio on she didn't realize the engine stalled. Only discovered it when she was trying to brake reaching end of the hill. She said a prayer and the car finally came to a stop just inches for the front gate of a house at the foot of the hill. It was at about 6am so there was no traffic.

Seems a bit of a crapshoot.

Your dealership is screwing you then. I have been told (and it says it on my car service record) that my drivetrain warrantee is 5ys/150000km with a general warrantee of 3ys/unlimited. It applies to ALL VW's that have current warrantee periods.

I've just had DSG issues on a 2009 Golf and have had no problems having VW honour the new five year warranty. I didn't have to argue about it at all. They replaced the clutch pack very quickly, though we had arguments about replacing the Mechatronic unit, which they wouldn't do.

One firm of solicitors has already dumped the case, which gives you a decent idea of how workable it is.

Stamping up and down and shouting "IT'S NOT FAIR" is not a winning legal argument.

The ACCC cannot do anything to force a recall. I know. I have already put in a formal submission. The answer came back that if it is a claimed safety issue, then the Department of Infrastructure and Transport has to determine whether it is a safety issue. If it is and can be substantiated then the DIT will notify the ACCC who will then announce the recall.

If it is not a safety issue, then it is just a dispute between a buyer and seller and there are plenty of existing avenues for this (i.e. the courts and tribunals).

The minister simply does not have the power to step in for a dispute.

If VW digs its heels in, then it is simply the reaction of the public that impact on sales that will see them change their stance. As things stand, they have acted in markets where a sales are significant or where regulations required them to act. Australia does not have the same regulations and they apparently feel they can lose the entire Australian market and it would be like a mosquito bite on an elephant.

Of course, we will still have to buy spare parts from VW (unless the Chinese can be good friends and allies and knock them off at super discount prices ).
