Not attacking you, but if my boss touched one of the girls I work with, would she only get $200? I don't think the institution has anything to do with it.

She made it about money I think to bring attention to the case. If she gives her "winnings" to charity she will still get paid a lot from all the attention she has brought on herself.

I heard that surviving familes of people who died from asbestos poisoning were awarded 250k.....

This woman wants 37 mill..... I think she should lose based on her greed! I dont care if she gives it to charity or not, as I said she has fabricated this figure to draw attention.

Look at what families of soldiers or police officers who are killed serving us receive and it's a fraction of what she's claiming. Even gang rape victims get only $50,000 but I guess the difference is that they're not raped by a rich company.

He (according to her claims) made a comment to her about her tasting a desert and touched her bra strap and on another occasion put his hand around her and attempted to kiss her.

The figure is based on 5% of the companies profits and 5% of his salary in punitive damages. The launch of the legal action was on the eve of David Jones spring/summer fashion launch and everything she said was scripted down to the fake tears thanks to the ambulance chasing lawyers she hired. They're the same ones who sued a large multinational because a female partner didn't earn the same as some other partners.

    This whole thing smells bad.

I am just wondering why she gets a percentage of the company profits?

If DJ's covered it up in a bury their heads in the sand type thing how does she get 5% of the profits it will never stand.

its called punitive damages. the idea, which is fully exploited in the US, is you are "punishing" the offender and a percentage of retail business profits is a great way of punishing them, so yes the institution is relevant.

I work for a huge oil and gas company, and my 3rd party liability insurance is huge, not because we have a greater risk, but because we have a lot of money, and therefore a far greater chance that if someone is injured, they will be seeking a hell of a lot more in damages from us

    Probably none of it.
It's rediculous that she can even want to claim that much.

I swear American's and their liability laws have screwed up the way the world works.

If you decided to sell your car for say $5000, you would advertise it for $6000. The buyer will offer $4500. You settle on $4750. The buyer thinks he has a bargain.

Always ask for more than you want. She will never see anywhere near $37 million (This figure would have been dreamed up by lawyers).

The figure just gets the main players in the game to sit up and take notice. Free front page publicity gets people talking. David Jones just wants this to go away and asking for $37 mill means it wont.

I feel sorry for the girl, she had an ass of a boss, her 15 minutes of fame will aways be known as That-Girl-That-Asked-for-$37-Million. The lawyers will take most of any payout. The case will drag out for years. This is not her fault.

She chose how this went down so yes it is her fault, she's selling her story to everyone that will pay for it. She's after money but trying to make out she's defending all the poor women out there who don't have the celebratory lawyers and publicists to back them up.

And it turns out that this isn't her first claim of this nature, she tried to claim that a manager invaded her personal space when working as a civilian for a police "agency" only last year.

Regardless of the law in this country, sexual harassment in the workplace is still happening and the perpetrators will only be punished and stopped if the victims speak out. This very public case is but the tip of the iceberg. Most victims are not supported by their workplace, they are afraid or they feel it's easier to simply resign and seek another job. Meanwhile the harasser keeps their job and continues doing what they've always done to the next person who is unfortunate enough to have to work with them.

This seemingly outrageous claim is necessary to show corporate Australia that this behaviour will not be tolerated and if it makes people think twice before they say or do ... then it is worth it.

Good on her for having the courage to bring this man and his organisation to task.

Some of the comments on this thread are proof that we need a big public case so the issue is taken seriously and the harassment will eventually stop.

I don't care what she does with the money. She'll have an interesting time getting another job in her field.
