There are no regulations (In NSW at least) that stop CAI other than they must not degrade the emission spec of the original vehicle.
So unless its in the inside original airbox ANY inspection station will spot a CAI inc the gruppe m - they are not really that stealth when it shouts - LOOK AT ME, I AM CARBON FIBRE!!!
So the issue would be more a warranty / manufacturer voided issue not a legality issue I feel unless you are being silly and the cops decide to be annoying and try to defect it by checking your vehicle over.
I just had our vehicle engineer on the phone (QLD ONLY) & he ran through several scenario's - He has been an engineer for 15 + years & is called in to consult for people who have been "defected".

Coppers are pretty smart - they can open your hood & look inside, they can see intercoolers hanging on the front of the cars, they can measure vehicle height (by ground clearance) and can do basic roadside noise tests as well.

I can't comment on the Guppe M airbox, but he said one person was recently defected by running the " Factory BMW M sport airbox" from BMW, and when inspected a second time, as it was fully enclosed & used the original airbox opening or inlet, it was deemed ok. He also said - its the first visual under the bonnet that will make or break you. Open the hood of a new RS6 & you are swamped by Carbon Fibre! - Hint's were no exposed pods, no chrome or polished intake tubes, no visible shiny blow off valves, no shiny catch tanks & unless you have just been busted doing burnouts, the chances are pretty slim that they will defect you!

If in doubt, pay an engineer a hundred bucks to certify it!
