You are misinterpreting what this does .
As standard it prevents you passing in the left or slower lane. By disabling it it allows you to pass on the left of a vehicle in the next lane.
What is happening is that the car slowing down in the next laneas your car gets within the braking area of the ACC and so tries to avoid running into it
.
Shouldnt do it really as on a multi lane road it would brake as you passed a car in an adjacent lane.
I dont have any problems like that on the highway Its just set and forget and it cruises past slower traffic fine.
It could be that you are still in line to a degree and it sees it as a problem. Try pulling to the right a bit as they slow and see if it helps
Take it in to the dealer and explain it carefully.
