Mechatronics issue

Hi all,
Please excuse my lack of knowledge, but I guess that's why I'm here.
i have a 2012 Passat.
Recently I noticed that the gears were changing to quickly eg. It would be D7 at 70kmh.
Then about a week ago my car started falling out of gear while I was driving and stalling.
I did some research and learnt about the recall in 2013. I bought my car secondhand in 2014.
I contacted VW who said my car hadn't been recalled for a DSG replacement.
My car is with the service centre at the moment and they've said the mechatronic system needs replacing and that they'll contact VW and request that they replace this under goodwill.
Clearly my car should have been recalled as it was a Feb 2012 model (I've read they only recalled 2008-2011 models) and my car has a 7 speed gearbox which seems to be the faulty gearbox.
Has anyone else been in my situation?

Mine is in top gear long before 70kph. But then I dont push it hard
