I'd be wanting a written report, detailing their reason for the engine failure,(NOT a report stating the tuner is at fault), VW stating their position with regards warranty coverage, then take it from there.

Yes, just keep the recpord of all of that, also send them email, I would also send a registered letter.

I suspect there's some ass covering going on. If this is the same dealer that has done your services then if there were problems here (like no oil change or wrong oil) then this would explain the reason the bearing failed. It would then come back to the dealer to fund the new engine.
Seriously get an independent assessment and a written report.
I wouldn't be authorising any work until this was done and the primary cause of failure found.

Nah probably if you've told them that you're getting legal advice then they've probably decided not to talk to you other than through lawyers. I'm not saying this is definitely what is happening, however it's a possibility.
Also it may be that it's been put in the "too hard basket" and you may need to go and talk to the service manager/dealership principal/warranty manager at VW to get things moving.

So is it still only one bearing that has failed and nothing else at all ? total BS on the dealers part if that's the case
That's all I could see damagaged from my photographs and the diagnosis for a new short engine was given after only one of the pistons was taken out. The remaining 3 are still on the car as is the cylinder block.
Have been promised call backs from the dealer since last Wednesday (7 days ago) but since then nothing! So I'm no clearer on whay has failed and why, apart from telling me, "you car has been chipped", "you have no warranty", "it will cost £5,500 to repair" (estimated!)
