I would think the insurer would foot the bill, as they have a moral if not legal obligation to get their client's vehicle back on the road as soon as possible. After all, the vehicle did crash and suffer extensive damage, and there was no mention of the driver breaking any law. Unfortunately, the policy holder would have to foot whatever excess applies. Afterwards, the insurer may put a claim in to Volkswagen in an attempt to recover some or all of their costs, including the excess, but I'm sure Volkswagen wouldn't cough up until they conducted their own investigation to determine if the wheel failure was due to a manufacturing defect. If they are honest and determine that it was, it would be interesting to see if there is a recall.

Normally it's the cheap reps that shatter like this particular wheel did (which is why I always push people to choose a branded wheel or stick to other OEM options when wanting to change their wheels). This clearly looks like a manufacturing or metal defect in some form or another, and assuming this incident occurred in normal driving - as indicated by the story - then I would think VW would have to come to the party.
I am guessing the Cadiz wheels are probably made by Ronal, pretty sure I saw their stamp on my Austins and they traditionally have done a lot of VW OEM wheels. Whether they determine a full recall and replacement is warranted, or some form of check on these wheels is conducted, time will tell.

B6 Passat Wagon No KESSY
So finally I can say that I am a VW owner
Picked up my R yesterday and as yet have been sitting in traffic.
Suffice to say that it is a comfy place to sit.
The whole tyre conversation made me check mine this morning, and I have Potenzas fitted so all ok there.
Will try and grab some photos when I get the chance.

The GTI-PP has 7.5 inch rims, which is the minimum recommended width for 225 section tyres, whereas the R has 8 inch rims, which is the minimum recommended width for 235 section tyres. Most auto makers seem to fit the minimum recommended width tyres to the specified rims.
