OK you don't get your car back with a charged system, problem fixed. I will discharge it with you as a witness and hand the car back in the same condition it came in with. I don't care whether it never works again, it isn't me riding around in it so I am not inconvenienced and one customer less won't bother me. That is exactly what would happen and bring the law on because I have not supplied a car that is breaking it. Happy Days!

Aren't cars and their components supposed to be "fit for purpose" ? Somehow I think an aircon that doesn't cool (or works for a short time then stops working because all the gas has leaked out) kinda fails that test. And the ACCC has some laws as well covering that exact situation.

So VW can't wriggle off the hook entirely, regardless of what nonsense one of their agents (the offending VW dealer) are trying to claim (ie we haven't found the leak so there definitely isn't one).

I totally agree but if I can't find the problem or do not have the equipment or skills to do it then the vehicle gets returned to the owner ungassed if that is the legislation and let someone else sort it out, in fact there is now a legal obligation to do just that the way I see it.

All we know is, that it didn’t leak second time since the dealer repair/re fill it. I understand that the OP is just chasing his refund, or do I misunderstand it?

I’ve read the first post again and IMO, it could be solved without heated argument, which it was according to first few lines in the OP.

I believe that one achieves more dealing with this kind of issue (charged for warranty work) any kind of issue with being calm. I’d have just paid them and contacted the head office immediately. I’ve done that in past and not just once, it was always very effective and quick.

And that is exactly why I sold my mechanical business, customers are not willing to understand and be tolerant with problems that become ongoing, they instead become threatening and abusive which I never understood. They refuse to listen to any reasonable explanation and this is not isolated but very common. Cars are great, it is the owners that p*** me off.

I had a friend who was a panel beater and when a customer left his car with him he told them not to bother ringing him for a report as every time they did it would delay the return of the car. Some arced up about this so he gave them the keys back and pointed to the front gate.

Several hight level people from various places got involved in this.
Several people e.g. Ozsko, I think were suggesting that an A/C leak was just life and I should get over it. And to be told "all the Gas is gone but there is no leak" is a perfectly normal thing to say to a thinking human being. What a lot of crap.

I received an apology, and a refund. All now finally agree there is a leak but its really hard to find. I am perfectly fine with that. Unfortunately it is now an ongoing wait to find the leak.

I think that this situation is a little different. If it has a 3 warranty then everything must work for 3 years at no cost to owner. VW were 100% wrong here in charging the owner.

When diagnosis is difficult the customer must be patient. Remember there is no minimum IQ for tradesmen.

Which is what I suggested should happen but then you told all of us it was illegal to do that.
