    Tuned or not?

    I took the polo gti in for its 15k service today and was told after i complained about the dsg slipping that the car had a tune and the clutch packs were slipping at no fault of their own. I purchased the vehicle recently from the same dealer and the vw service tech assured me that my car was definitely tuned, i wasn't so sure until i drove another my13 gti they had on the yard and now I'm convinced something has been done to my vehicle by the previous owner. So how do i find out whats been done? I also thought APR tunes still weren't available for CTHE engines as yet. A quick call around to Giac tuners and i couldn't find one who could remember a 13.5 gti. VW cannot see on their diagnosis at the yard whats been done but did tell me they can send the data to sydney to be analysed ,but if they confirm parameters have been changed in my ecu they will void my dsg and engine warranty , so I obviously told them not to send the data but I'm at a loss at what to do to find this out?
    any ideas??

    If it's the same dealer you bought the car from then I would be calling in the dealer principle. Their staff are their responsibility and if they have sold you a tuned car without telling you (highly unlikely anyway) then they are surely going to be breaching some form of agreement, probably "sale of goods under false pretense" or along those lines.
    You will be surprised how quickly these dodgy mofo's that plague VW dealerships across Australia will start playing ball when you mention ACCC, Australian consumer law and court proceedings. If suddenly they confirm that the car ISN'T tuned, demand a valid reason as to why they would say it is when it wasn't. If they start stumbling about an excuse, say to them -word for word- "if it was tuned, then surely the diagnostic system would have shown a TD1 flag, would it not?" And see what they come up with. Then, you should get some new clutches

    Is anyone else getting tired of how many times legal issues have to come up regarding these bloody polo GTI's?!

    So basically they sold you a car still under warranty knowing full well it was tuned, yet they won't honor the repair costs under the warranty??? Cheeky effin sods!

    They will have to prove it was in fact the tune that caused the failure of said parts...and that's highly unlikely, so maybe you should get a tuner to do a full diagnostic report for your own piece of mind and then take that to the dealer.

    We'll the only proof they have so far that it's tuned is the testimony of the vw tech who drove it, to be honest when I drove the other one at the yard there was a noticeable difference in midrange and pickup between mine and the yard car, ie my Tc light flashes a lot more in second and third, I'll wait for the 30km service and request the clutches get attention otherwise I will go to the accc, I have the full report copy from the tech for today's work and assurance my clutches are still under warranty in the dsg.

    Maybe my other option is to go to a different dealer for the 30km service and mention the slipping, see what they say?

    Don't. Take my advice when you go in an question them and see what they say, it is the only way to find out I they're just (typically VW) screwing you to get out of fixing the car.

    Definately dont go to a different dealer.
    If its a VW dealer surely they would of scanned the car prior to them purchasing it, either way keep on em

    Cant some of the tune settings be accessed from the cruise control stalk on some tunes?

    If a car is tuned would there be some sort of history as to when the tune was actually performed?

    It would be easy to log it with VCDS and see if it's been tuned.

    My feeling is no. As no one is flashing the latest version of the ECU in the GTI that I am aware of.

    I looked at one in January last year and that couldn't be read in boot mode.

    So can I argue this point with the dealer? That it's not possible it's been tuned
