I also looked, The inspection Checklist was done 7th month last year and i took Delivery in the 12th Month, Can i catch them out on this? Arent they meant to do a Pre Delivery Check up list?

Fair trading law states that if the vehicle has factory warranty on it and the service departments attempts to fix the issue (successful or not) then you are not entitled to a return or new vehicle.
There may be a clause in your terms of sale in regards to a 21 day cooling off period..
If the vehicle has attempted to be fixed and the dealer has come back with "a characteristic of the vehicle" and the vehicle still operates... then it is operating as intended (to take you from point A to point B)
Your next step is to phone VW customer care to have the issue escalated.
