Hi, on a weekend was shocked to see massive hole on a edge of the drivers seat
the area is right next to the elbow....
I guess the question is should this be covered by warranty since its the actual stitching that gave up in a area that is hardly used or has constant pressure applied to it
any one had anything like that?

I think it should be covered. When I bought my MKV my passenger seat had a loose piece of leather/stitching, they couldn't fix it so they ended up ordering in a whole new seat for me free of charge. I only noticed it a week after I bought the car. The car was a demo too so if you bought it brand new you should have no dramas.
