    I have been down this road before with another rather lagre German car company. They just laugh at threats of legal action, they have more lawyers than you can imagine. When I looked into it a bit further it turns out they like to make things drag on for years until your legal costs look like a telephone number.

    Australia really needs lemon laws, the amount of Money that goes into sales and luxury car tax you think we could have a few laws regarding the quality of cars... Sorry I get off my soap box now.

    VW Australia should be brought into this and you should run a petition and get as many signatures to support your case as you can. I am happy to sign and get all my friends to join as well. That way they would not only have one unhappy customer,they would have thousands...
    Not a look they want for sure! As far as the dealer goes they are all the same sh..t.

    If I buy a new phone. and its D.O.A, I would take it back to the place I bought it for a refund or exchange. If on the other hand it stops working 6 months later, I would then give the manufacturer a call and go through normal routine.

    I can imagine the disappointment of the OP, new car and it has to go to the workshop almost from the showroom, but that's why there is a 3 years warranty and it is far from lemon mate.

    17th/Dec/2010 01:00pm - Called Dealer followup, hasn't replace yet
    17th/Dec/2010 04:30pm - Call from VW, Parts replaced, but still getting same error, have to leave till Monday
    20th/Dec/2010 11:00am - Called Dealer followup, running Diagnose again, no ETA for my Car
    20th/Dec/2010 12:40pm A Call from Dealer, Could be throttle sensor wire fault, ordered a parts...
    21/Dec/2010 2:45pm Dealer Called, Parts just turned on 1Hr ago, May finished the fit-in tomorrow, and contact me tomorrow afternoon.
    22nd/Dec/2010 2:45pm Dealer called, Throttle Wire fitted in, But SAME Error again. VW Tech suggest replace the Engine Computer MAY fix the problem, Needs to order from Germany, will take 3-4 Weeks to arrive then fit-in.Loan car needs to take back due to its Sales Department Demo Car. VW Representative will contact me tomorrow morning.

    WTF, Brand New Car..and Return to workshop in 15Hrs...

    and, Can't even find what the problem is till now.

    They refused to replace the vehicle or refund.

    Thinking to get lawyer or lodge to ACCC

    Anyone had similar situation before??

    I love Golf, My Golf III died few weeks ago. Now Dealer and VW is trying to disappoint me from many years great experience.
    Your record keeping fascinate me, I usually don't record the time when my car does something weird or fail and keep tracking all calls after wards and so on,; why is that? Have you been through the similar situations before, more than once? Or you just put down the approx. time? Did you threaten the dealer from the beginning with ACCC and lawyer while demanding a refund for the car? If you did, I’m not surprise that their want their loan car back, it’s not in the warranty condition that they have to give you a loan car for free until they repair yours.

    From my point of view, it is not their fault that the car developed a fault and even ACCC would tell you that you have to give them chance to repair it.

    Unfortunately, we don't have a lemon law in OZ, so they don't have to replace your car with a new one.

    I hope that they fix it soon and all goes well for you.

    The reason is simple, Mobile phone call history.

    and No, I haven't say anything to the dealer YET!

    I just keep my record and share on the forum!

    at a minimum, the dealer should compensate for a loan car. the poor guy bought a car, hoping to use, and if he gets shafted with no loan car then he has no transport at all. plus if he is leasing the car, thats repayments for nothing. bogus imo.loan car at the minimum

    Yes, I would not call this a "lemon".

    IMO, this is a clear case of DOA. In which case, for other things you buy, it is normal to get replacement or refund. Not repairs and more repairs.

    If it was me, I would nip this in the bud and push hard for the right outcome, even if it means getting a lawyer in.

    Better to be a tough customer than a "chump".

    I don't think that you would have a chance, mate. The car is not a laptop. Besides, it is not like the engine would seize or something and not even then. Once you drive on the road with the car registered in your name, I think it would be the VW good will only, if they agree to replace your vehicle with a new one.

    I would stay calm, firm and realistic.

    IMO, same same. Goods or services protected by your Statutory Rights. A car is not exempt.

    In fact, I would be pushing for refund instead of replacement. Wise to get legal advice and go from there.
