Yes I think it is illegal. Doesn't seem to stop in happening with monotonous regularity at casino car parks and similar venues. Anyway, while it is probably not the reason for it being inactive by default, it is worth considering possible unintended consequences if you intend to activate it.

I assume warranty is void once its done?

There's no such thing as a warranty being voided on a car. The only thing is that VW can't be expected to cover the warranty of parts you install, or problems they cause, or problems you cause installing them.

In the case of this, there are no new parts, it's simply a software setting change. As long as you follow the commonsense guidelines of using VCDS, there is nothing you can do to stuff it up. However, if you do stuff up something in VCDS, you'd be liable to pay a VW dealer (or someone else) to fix it.
